Our Probate Practice
We handle all matters related to the administration of an estate, from the filing of all required documents to the representation of your interests in all hearings or other proceedings, including guardianships. We will help you prepare an inventory of the assets of the estate, make certain that the final debts and taxes of the estate are paid and work with you to oversee the distribution of property in accordance with the decedent's wishes. If any claims are filed against the estate or the will is contested, we will act as an advocate for the estate, handling claims at probate court if necessary.
We can help you establish and implement an effective plan for the distribution of your assets upon death. First, we will gather as much information about your finances and your goals as we can. Next, we will help you understand the different strategies for accomplishing your objectives, including the use of wills and trusts, the re-titling of assets and lifetime gifting.
Once you have decided which approach will help you meet your goals, we will prepare and execute all the necessary documents to put your estate plan in place, including:
- Living and testamentary trusts
- Revocable and irrevocable trusts
- Special needs trusts
- Powers of attorney
- Living wills and health care directives
- Payable on death designations
- Transfer on death designations
We also handle elder law issues, including Medicaid planning and asset protection planning.
